PRODUCT COMPLIANCE RULES
PART 1: BASIS & INTERPRETATION
1.1. The www.commercin.com website (hereinafter the “Commercin.com Website“) is a global marketplace composed of buyers and sellers (collectively the “Users”) who reside in various countries around the world. To ensure the safety of all users and to maintain an orderly marketplace in compliance with all applicable and relevant local laws and regulations, not all categories of products may be listed on the Commercin.com Website.
1.2. In addition to prohibiting and restricting the listing of products that are heavily regulated or completely banned by legislation, Commercin.com has also implemented prohibitions and restrictions on products that, although not prohibited by law, are controversial by nature. Examples include the following:
a) Items that encourage illegal activities (e.g., lock pick tools, synthetic urine for cheating drug tests);
b) Items that are racially, religiously, or ethnically derogatory, or that promote hatred, violence, racial, or religious intolerance;
c) Items that promote an element of chance (e.g., giveaways, lotteries, raffles, or contests);
d) Stocks, bonds, investment interests, and other securities;
e) Pornographic materials or items that are sexual or obscene in nature; and
f) Items that do not offer a physical product or service for sale, such as digital currencies.
1.3. This Product Listing Policy outlines categories of products that are either restricted from being listed or completely prohibited on the Commercin.com Website. The categories and examples listed below are not exhaustive or all-inclusive and should be used as a general informational guide. Sellers are always responsible for ensuring they do not list or sell products that are restricted or prohibited under any applicable laws.
1.4. Sellers are reminded that laws vary across different countries, and the regulations in their country of residence may not be the same as those in the country where their potential buyers reside. Therefore, before listing any product on the Commercin.com Website, all sellers are strongly encouraged to seek legal advice from a duly licensed legal practitioner in their own country and the country they wish to sell to, ensuring compliance with all relevant laws and regulations before selling on the Commercin.com Website.
1.5. For the purposes of this Product Listing Policy, a “Relevant Online Transaction” refers to a transaction that is supported by the Commercin.com Transaction Services Agreement.
1.6. Commercin.com, at its exclusive and absolute discretion, reserves the right to amend, modify, or otherwise alter the list of products subject to listing restrictions or prohibitions at any time, with or without prior notice. In the event that Commercin.com exercises such discretion, there is no requirement for such amendments to be reflected in this Product Listing Policy. However, as a general practice, a notice to that effect will be made available under the Product Compliance Rules Section of the Rules Platform within the Commercin.com Website. Users are encouraged to stay updated on these notices to ensure they are informed about whether a particular product may be listed on the Commercin.com Website.
1.7. In the case of any inconsistencies, ambiguities, or conflicts between the contents of this Product Listing Policy and the terms, conditions, or contents of any other document applicable to the use of the Commercin.com Website (including different language versions of this policy), the English version and the decision of Commercin.com, exercised in its absolute discretion, shall prevail.
Part 3. PROHIBITED ITEMS SUBJECT TO SANCTION
17.SANCTIONED AND PROHIBITED ITEMS
17.1 Commercin.com expressly prohibits the listing and sale of any products prohibited by laws, regulations, sanctions, and trade restrictions of any country/region including but not limited to:
a) Minerals, industrial machinery, edible farm produce, electronics and electrical equipment, energy, information technology, medical products, logistics, soil, rocks, wood, ships, sculptures, seafood, aquaculture, and textile products from North Korea;
b) Wood from Somalia;
c) Tourism industry products from Cuba; and
d) Any other products derived from or manufactured through forced labor.
17.2 By reason of laws, regulations, sanctions, and trade restrictions of certain countries/regions, Commercin.com expressly prohibits the listing and sale of:
a) Industrial machinery, helicopters, vehicles for use in logistics, metals such as steel and iron, crude oil and petroleum products, aviation fuel, condensate oil, and liquified natural gas to North Korea;
b) American-made luxury goods such as watches, fur, luggage, cosmetics, silk, perfume, carpet, crystal, porcelain, fine art, jewelry, laptops, and instruments to Russia;
c) Belarus-manufactured potassium fertilizer, cigarettes, petroleum, wood, cement, steel, rubber, industrial machinery to European Union member states;
d) Belarus-manufactured crude oil, petroleum, petroleum fuel, petroleum distilled products, liquified natural gas, coal and coal products, fish-related products, seafood, and processed seafood products and non-industrial mineral ores to the United States; and
e) Russian-originated coal, cement, rubber, steel products, wood, spirits, white wine, and seafood products to the European Union.
Part 4. GEOGRAPHIC SPECIFIC PROHIBITIONS
Pursuant to changes in the international trading environment and in light of different legal and regulatory requirements of applicable destination countries, Commercin.com may apply geographical product control policies against different products based on applicable laws and regulations of applicable countries. The categories of products and the examples of such products detailed below are not intended to be exhaustive or all-inclusive and will be updated from time to time by Commercin.com. Users of Commercin.com are reminded that any listing and/or trading on Commercin.com must be fully compliant with the applicable laws and regulations of destination countries.
18. Laser Products
18.1 Commercin prohibits any products classified as Class IIIa laser products to be listed or sold to the following countries/regions:
a) EU
b) UK
c) US
d) Australia
e) New Zealand
18.2 Commercin prohibits the listing and sale of any Class IIIb laser products.
18.3 Commercin does not subject Class I and Class II laser products to any restrictions or prohibitions and can be listed on the Commercin Website normally.
19. Illicit Drug Manufacturing Equipment
19.1 Commercin prohibits the listing and selling of any illicit drug manufacturing equipment, including but not limited to, any manual, semi-automatic or fully automatic pill press machine that may be used to compact or mold powdered, granular or semi-solid material to produce coherent solid tablets, any manual, semi-automatic or fully automatic encapsulator that may be used to fill soft or hard capsules with any powdered, granular, semi-solid or liquid material, any products which may be categorized as pill press, tablet press and dies, capsule filling machines and soft gelatin encapsulation machines, or any parts, molds, or dies associated with the aforementioned machines, to the following countries/regions:
a) United States
b) Canada
c) Australia
d) Mexico
e) United Kingdom
f) European Union
g) Brazil
20. Radio Equipment
20.1 Commercin prohibits the listing and selling of all radio equipment, such as (i) electrical or electronic products which intentionally emit and/or receive radio waves for the purpose of radio communication and/or radio determination, (ii) electrical or electronic products which must be completed with accessories, such as antennas, so as to intentionally emit and/or receive radio waves for the purpose of radio communication and/or radiodetermination, (iii) repeaters, (iv) signal boosters, and (v) mobile phone repeaters, to the following country/region:
a) Ireland
21. Personal Protection Equipment (PPE)
21.1 Commercin prohibits the listing and selling of cadaver transport packages, virus test kits, and any other products which imply a relationship with COVID-19 or its treatment to the following country/region:
a) United States
21.2 Commercin prohibits the listing and selling of COVID-19 related PPE, test instruments, and disinfectant products to the following country/region:
a) Canada
21.3 Commercin prohibits the listing and selling of masks and disinfectants to the following country/region:
a) Poland
21.3 PPE is a restricted product category on the Commercin Website and only selected sellers with relevant qualifications as notified by Commercin are allowed to list and sell PPE products.
22. Single-Use Plastic Products
22.1 Commercin prohibits the listing and selling of single-use plastics, including but not limited to, cotton bud sticks (except those identified as medical devices), plastic cutlery, plastic plates, plastic straws (except those identified as medical devices), beverage stirrers, sticks to be attached to and support balloons (except balloons for industrial or other professional uses and applications), beverage containers, and food containers made of expanded polystyrene (caps and lids included), any products made from oxo-degradable plastic etc., to the following countries/regions:
a) United Kingdom
b) Spain
c) Italy
d) France
22.2 Commercin exempts the following items from the restriction detailed in Article 22.1 above, provided that a clearly legible marking shall be provided on either side of the packaging of the product or directly on the product itself to inform buyers about the presence of plastics in the product and appropriate waste management options for the product, including the importance of avoiding littering:
a) Sanitary towels (pads), tampons, and tampon applicators;
b) Wet wipes i.e. pre-wetted personal care and domestic wipes;
c) Tobacco products with filters and filters marketed for use in combination with tobacco products; and
d) Beverage cups.
23. Pesticides
23.1 Commercin prohibits the listing and selling of pesticides and pesticide equipment such as (i) products that claim to be able to manage, prevent, kill, attract, repel, or reduce toxicants (such as bacteria, viruses, and other organisms and micro-organisms) and (ii) sanitation products that can control toxicants such as disinfectants and antibacterial products, whether in the form of structural materials, devices and other products, biochemical and non-conventional products, agricultural chemicals, herbicides, pesticides/pest sprays, insect drugs, cockroach control, fungicides, insecticides/insect sprays, weedicides, acaricides, rat poison, rat bait, mosquito repellent liquid/sprays/bracelets, mosquito coils, herbal fragrance, antiseptics, and ultraviolet disinfection/germicidal lamps, etc., to the following countries/regions:
a) Canada
b) United States
24. Teeth Whitening Products
24.1 Commercin restricts the listing and selling of teeth whitening products to the following countries/regions on the basis of whether the product is classified as a drug or cosmetic in the relevant country/region, the chemical composition, and relevant labeling:
a) European Union
b) United States
c) Canada
25. Cannabidiol (CBD) Products
Commercin restricts the listing and selling of cannabidiol (CBD) and products which contain any CBD, such as CBD oils, CBD powder, and CBD cosmetics, to the following countries/regions:
a) Singapore
b) European Union
26. Sex Dolls
Commercin restricts the listing and selling of sex dolls (dolls which replicate the face and entire body of an adult and are created for the purpose of providing sexual pleasure) which are not prohibited pursuant to any of the Articles in 7 herein, to the following countries/regions:
a) Australia
b) United States
27. All Terrain-Vehicles (ATVs)
Commercin restricts the listing and selling of all ATVs (both four-wheel and three-wheel but not UTVs) to the following country/region:
a) United States
28. Explosive Precursors
Commercin restricts the listing and selling of explosive precursors, including but not limited to nitric acid, magnesium, sodium nitrate, and hydrogen peroxide, or products that contain explosive precursors to the following countries/regions:
a) European Union; and
b) United Kingdom
29. Products Containing Controlled Substances
Commercin restricts the listing and selling of products that contain the controlled substances detailed in [link to rules] to the following country/region:
a) United States
PART 4. RESTRICTED ITEMS SUBJECT TO PRODUCT QUALIFICATION
30. Restricted Items
30.1 For the sake of convenience, items which have been classified as restricted above, i.e. requiring to have the relevant product qualification requirements verified prior to listing and selling, will be reiterated herein. Commercin restricts the listing and selling of the following to those who are verified by the Commercin Website as holding the relevant qualifications:
a) Medical Devices;
b) Hoverboards;
c) Dermal Fillers;
d) Fireworks;
e) PPE;
f) Police Equipment and associated products; and
g) Tobacco processing equipment.
